Welcome to Djungo’s Terms of Use (the “Terms of Use”) that are a binding contractual commitment between you and Djungo AB, org. no. 559250-5068 (”Djungo AB”, “we” or “us”), and we want you to know yours and our rights before you use the Djungo application (“Djungo” or the “App”). Please take a few moments to read these Terms of Use before enjoying the App, because once you access, view or use the App, you are going to be legally bound by these Terms of Use.Your safety is our top priority. For your safety, we reserve the right to remove any user for a number of reasons, but most importantly if we believe they are acting inappropriately or misrepresenting themselves. If someone has made you uncomfortable for any reason, or should you have any questions, complaints or claims with respect to this Agreement or the Service whatsoever, please use the block and report function (see Section 6) in the App or contact us at hello@djungo.com. 1. ACCEPTANCE OF TERMS OF USE AGREEMENT
By creating a Djungo account, whether through a mobile device, mobile application or computer (collectively the “Service”) you agree to be bound by (i) these Terms of Use, (ii) our Privacy Policy https://www.djungo.com/privacy-policy, and (iii) any terms disclosed and agreed to by you if you purchase additional features, products or services we offer through the Service (collectively the “Agreement”). If you do not accept and agree to be bound by all of the terms of this Agreement, please do not use the Service.We may make changes to this Agreement and to the Service from time to time. We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, or changes in business practices. The most recent version of this Agreement will be posted in the App under settings and also on
djungo.com, and you should regularly check for the most recent version. The most recent version is the version that applies and we will update the “Last revised” date in these Terms of Use. If the changes include material changes that affect your rights or obligations, we will notify you in advance of the changes by reasonable means, which could include notification through the Service or via email. If you continue to use the Service after the changes become effective, then you agree to the revised Agreement.
2. ELIGIBILITY
You must be at least 18 years of age to create an account on Djungo and use the Service. By creating an account and using the Service, you represent and warrant that you can form a binding contract with Djungo AB, you are legally permitted to use the Service by the laws of your home country, you will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations, and you will comply with the Djungo Rules (see Section 5.1).
3. ACCOUNT
You are responsible for maintaining the confidentiality of your login credentials you use to sign up for Djungo, and you are solely responsible for all activities that occur under those credentials. If you think someone has gained access to your account, please immediately contact us by emailing hello@djungo.com. For more information regarding the information we collect from you and how we use it, please consult our Privacy Policy
https://www.djungo.com/privacy-policy.You’ll have great fun on Djungo, but if you feel the need to leave, you can delete your account at any time by going to settings when you are logged in to the App and clicking on the ”Delete account” link. Your account will be deleted immediately but it may take a little while for your content to be completely removed from the App. Your profile information will be treated in accordance with our Privacy Policy

We use a combination of automated systems and manual monitoring to screen accounts and messages for content (text as well as photos) that indicate breaches of these Terms of Use. We reserve the right at our sole discretion to terminate or suspend any account, or make use of any operational, technological, legal or other means available to enforce the Terms of Use (including without limitation blocking specific IP addresses), at any time without liability and without the need to give you prior notice. Without limiting the foregoing in any way, we expressly reserve the right to terminate or suspend your account without notice (1) for violating these terms, (2) due to your conduct on the App, or your conduct with other users of the App (including your “offline” conduct), if we, in our sole discretion, determine your conduct was inappropriate or improper, (3) if we or our affiliates, in our or their sole discretion, determine your conduct on other apps operated by our affiliates was inappropriate or improper, or (4) for any reasons whatsoever that we deem, in our sole discretion, justifies termination. If your account is terminated or suspended, you agree you will not receive a refund for any paid service or features you have already been charged for.
4. INTERACTIONS WITH OTHER USERS
Though Djungo strives to encourage a respectful member experience through features like the double opt-in with regard to 1:1 connections that allows members to communicate 1:1 only after they have both indicated interest in one another, it is not responsible for the conduct of any member on or off of the Service. You agree to use caution in all interactions with other members, particularly if you decide to communicate off the Service or meet in person.We don’t control any of the things our users say or do, so you are solely responsible for your interactions with other users with whom you interact through the Service; provided, however, that Djungo reserves the right, but has no obligation, to intercede in such disputes. You agree that Djungo will not be responsible for any liability incurred as a result of such interactions. You understand that Djungo does not currently conduct criminal background checks on its users or attempt to verify the statements of its users. Djungo makes no representations or warranties as to the conduct of the users or their compatibility with any current or future users. Djungo reserves the right to conduct any criminal background checks or other screenings (such as sex offender register searches) at any time and using available public resources.
5. DJUNGO RULES AND USER GUIDELINES
5.1 Djungo Rules
- By using the Service, you agree that you will NOT
- use the Service for any purpose that is illegal or prohibited by this Agreement,
- use the Service for any harmful or nefarious purpose,
- use the Service in order to damage Djungo,
- violate our User Guidelines (see Section 5.2) spam, solicit money from or defraud any members,
- impersonate any person or entity or post any images of another person without his or her permissionbully, “stalk”, intimidate, assault, harass, mistreat or defame any person,
- post any content that violates or infringes anyone’s rights, including rights of publicity, privacy, copyright, trademark or other intellectual property or contract right,
- post any content that is hate speech, threatening, sexually explicit or pornographic
- post any content that incites violence; or contains nudity or graphic or gratuitous violence,
- post any content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual,
- solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other members or disseminate another person’s personal information without his or her permission,
- use another member’s account, share an account with another member, or maintain more than one account,
- create another account if we have already terminated your account, unless you have our permission.
Djungo reserves the right to investigate and/or terminate your account without a refund of any purchases if you have violated this Agreement, misused the Service or behaved in a way that Djungo regards as inappropriate or unlawful, including actions or communications that occur on or off the Service. Although Djungo reserves the right to review and remove content that violates this Agreement, such content is the sole responsibility of the member who posts it, and Djungo cannot guarantee that all content will comply with this Agreement. If you see content on the Service that violates this Agreement, please block and report the relevant profile within the Service (See Section 6) or by emailing hello@djungo.com.
5.2 User guidelines
These User Guidelines (and our Terms of Use in general) are designed to ensure every user has a safe and enjoyable experience on Djungo. Failure to adhere to these guidelines may result in losing access to our platform.
Upload only your own photos
We take copyrights very seriously. If you don’t own the rights to a photo or video, please don’t post it.
Show respect to other users
We’re a very diverse community. This means you should respect other people’s beliefs, interests and property while on Djungo. Djungo takes a strong stance against hate speech, rude or abusive behaviour, bullying, and misogyny. You should behave the same way on Djungo as you would in real life. Additionally we encourage all of our users to block and report (See Section 6) anyone who does not follow these behavioural guidelines. We expect all of our users to respect each other, themselves, and the Djungo staff.
Send original messages to other users
We strongly advise against copying and pasting the same message to every connection. We encourage our users to read profiles, learn about other people’s interests, and send an appropriate, relevant message to each match. We promise this will increase your chances of engaging in interesting conversations.
Don’t pretend you’re someone else
As previously stated, do not post photos that are not of you.
Djungo photo guidelines
No kids on their own. They must be in the photo with an adult, and fully clothed. No photos in bikinis/swimwear indoors. No pictures in underwear. No Shirtless/underwear. Face must be clearly visible in at least one photo. No watermarks or text overlaid. No pornographic material. No graphic hunting photos. No guns.
6. REPORT SUSPICIOUS AND OFFENSIVE BEHAVIOR
We don’t like users misbehaving on Djungo and we encourage you to report any abuse or complain about user content by emailing
hello@djungo.com, outlining the abuse and/or complaint. You can also block and report another user directly in the App. We reserve the right to investigate any possible violations of these Terms of Use, and we may, in our sole discretion, immediately terminate any user’s right to use of the App without prior notice, as set out further in Section 3 above. If we have taken notice that you don’t respect our Terms of Use, you might receive a warning (unless our team decides to terminate your account without warning at our discretion). If you ignore a warning from us, you risk losing your account. These guidelines are designed to make Djungo a friendly and safe place for all our users.
7. LICENSES AND OWNERSHIP
Djungo grants you a personal, revocable, limited, non-transferable license to use the features and functions of the Service to reproduce and use the App on your mobile device solely for your own personal use. Furthermore, with respect to any App accessed through or downloaded from the Apple App Store, Google Play marketplace, or any similar store or marketplace (each, an “App Store” and references to an App Store include the corporate entity and its subsidiaries making such App Store available to you), you agree to comply with all applicable third party terms of the relevant App Store (e.g. Apple App Stores “Usage Rules”) (the “Usage Rules”) when using the App. All updates and upgrades to the App will be governed by the version of these Terms of Use published by Djungo as of the date you install such update or upgrade. You agree, however, that we are not obligated to create or provide any support, corrections, updates, upgrades, bug fixes, and/or enhancements of the App or for the Service. In consideration for Djungo allowing you to use the Service, you agree that we, our affiliates, and our third-party partners may place advertising on the Service. By submitting suggestions or feedback to Djungo regarding our Service, you agree that Djungo may use and share such feedback for any purpose without compensating you. Djungo does not claim ownership of any content, images, videos, text, or other materials you upload to the Service. You grant Djungo a non-exclusive, fully paid, perpetual, irrevocable, worldwide, royalty-free, and fully sublicensable right (including any moral rights) and license to use, license, distribute, reproduce, modify, digitally transmit, publicly perform, and publicly display, your content (in whole or in part) for any commercial and/or business purpose whatsoever, including for the purpose of operating and providing the Service to you and to our other end-users. For the purposes of clarity, you may use your content solely for your own personal, non-professional purposes. You warrant that the holder of any worldwide intellectual property right, including moral rights, in your content, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. You agree that you, not Djungo, are responsible for all of your content that you make available on Djungo. Unless otherwise noted, the Service and all text, content, and documents in relation to the same, any names, logos, trademarks, service marks, brand identities, characters, trade names, graphics, designs, copyrights, trade dress, or other intellectual property appearing therein, and the organization, compilation, look and feel, illustrations, artwork, videos, music, software, and other works of the Service are owned by Djungo (or its affiliates) or used with permission or under license from a third party and are protected under copyright, trademark, and other intellectual property and proprietary rights laws. As between Djungo and you, all right, title, and interest in and to the content of the Service will at all times remain with Djungo and/or the relevant third parties. All brand names, product names, titles, slogans, logos, or service names and other marks used on the Website, App or Service, are registered and/or common law trade names, trademarks, or service marks of Djungo or the applicable third party.
8. PRIVACY AND TERRITORIAL LIMITATIONS
For information about how Djungo collects, uses, and shares your personal data, please check out our Privacy Policy https://www.djungo.com/privacy-policy. By using Djungo, you acknowledge that we may use such data in accordance with our Privacy Policy. By using the Service, you agree and acknowledge that it is hosted within the European Union. If you are attempting to access the Service from a physical location outside the European Union, or any region with laws or regulations governing personal data collection, use, and disclosure that differ from Swedish law, please be advised that through your continued use of the Service, which is governed by Swedish law, these Terms of Use, and Djungo Privacy Policy, you are transferring your personal information to Sweden and you consent to such transfer and the application of the laws of Sweden with respect to any dispute arising from or Djungo to the Privacy Policy and/or your use of Djungo, other than such rules, regulations, case law, and/or international treaties that would result in the application of the laws of a jurisdiction other than Sweden
9. DISCLAIMER
The Service is provided to you “as is” and “as available” without warranty of any kind with respect to Djungo and/or content, either express or implied. Should applicable law not permit the foregoing exclusion of express or implied warranties, then we hereby grant the minimum express or implied warranty required by such applicable law. No advice or information, whether oral or written, obtained by you from us, our employees, agents, suppliers, or any other persons will create any warranty, representation or guarantee not expressly stated in this section. Additionally, we do not make any warranties that the service will be uninterrupted, secure or error free or that your use of the service will meet your expectations, or that the App, the website, our content, or any portion thereof, is correct, accurate, or reliable. Djungo reserves the right to change any part of the Service at any time without notice.
10. LIMITATIONS OF LIABILITY
Your use of the Service is at your own risk. Neither Djungo AB, its affiliates, nor any of its respective officers, directors, agents, or other representatives will be liable for any damages, direct, indirect, incidental, consequential, special, or punitive, including, without limitation, loss of data, income, profit, or goodwill, loss of or damage to property and claims of third parties arising out of your access to or use of the App or arising out of any action taken in response to or as a result of any content or other information available on Djungo, however caused, whether based on breach of contract, tort (including negligence), proprietary rights infringement, product liability or otherwise. The foregoing will apply even if we were advised of the possibility of such damages. If you become dissatisfied in any way with the App, these terms, or the Privacy Policy, your sole and exclusive remedy is to stop your use of Djungo. You hereby waive any and all claims against Djungo AB and its affiliates, agents, representatives, and licensors arising out of your use of the App. If any portion of this limitation on liability is found to be invalid or unenforceable for any reason, then the aggregate liability of Djungo AB and its affiliates will not exceed one hundred euro (EUR 100). The limitation of liability herein is a fundamental element of the basis of the bargain and reflects a fair allocation of risk.
11. INDEMNITY
All the actions you make and information you post on Djungo remain your responsibility. You agree, to the extent permitted under applicable law, to indemnify, defend and hold harmless Djungo AB, our affiliates, and their and our respective officers, directors, agents, and employees from and against any and all complaints, demands, claims, damages, losses, costs, liabilities and expenses, including attorney’s fees due to, arising out of, or relating in any way to your access to or use of the Service, your content, or your breach of this Agreement.
12. THIRD PARTY APP STORE
In the event of a conflict between a third party App Store’s or mobile carrier’s applicable terms and conditions and these Terms of Use, the terms and conditions of the App Store or mobile carrier shall govern and control. We are not responsible and have no liability whatsoever for third party goods or services you obtain through a third party App Store or mobile carrier. We encourage you to make whatever investigation you feel necessary or appropriate before proceeding with any online transaction with any of these third parties.
13. TERMINATION
Djungo may cancel, suspend or block your use of the Service without notice if there has been a violation (or suspected possible violation) of these Terms of Use, as determined by Djungo in its sole discretion. Your right to use Djungo will end once your registration is terminated, and any data you have stored on the Service may be unavailable later, unless Djungo is required to retain it by law. You may terminate your registration at any time. We are not responsible or liable for any records or information made unavailable to you as a result of your termination of registration. You agree that we will not be liable to you or any other party for any termination of your access to the website, App, or Service. Any limitations on liability that favor us will survive the expiration or termination of these Terms of Use for any reason.
14. GOVERNING LAW AND FORUM
The Agreement and any action Djungod thereto will be governed and interpreted by and under the laws of Sweden, without giving effect to any principles that provide for the application of the law of another jurisdiction.In the case of dispute, arising out of or in connection with this Agreement, including without limitation the validity, interpretation and application of this Agreement, you agree to contact Djungo AB directly in writing (by email or letter) prior to taking any judicial or extra-judicial action, in order to try and find an amicable settlement to this dispute. Any dispute, not being amicably settled, shall be settled by arbitration in accordance with the rules of the arbitration institute of the Stockholm chamber of commerce. The arbitration shall be conducted in Stockholm and the language used in the proceedings shall, unless otherwise agreed, be English.
